Start with the place, not only the floor plan

The same dwelling plan can be permitted on one property and require resource consent on another. The assessment starts with the zone, legal boundaries, hazards, infrastructure, earthworks and the effects of the proposed activity.

A proposal can be permitted, require resource consent because a rule is not met, or need more information such as a survey, flood level, title review or planner’s assessment before the pathway can be decided.

How the NES-DMRU fits

The NES-DMRU supplies national permitted-activity standards, but preserves specified district and regional matters. If a requirement is not met, the application is assessed under the relevant provisions of the applicable plan.

Needing consent does not automatically mean public notification. The council decides whether an application is non-notified, limited notified or publicly notified under the RMA process.

Identify the exact rule

Do not stop at a broad “overlay present” result. Put the proposed footprint on an accurate site plan, identify the exact standard or rule that is not met and ask what evidence or design change is needed before fixing the programme.
